Collections Trial

In November 2012, Stewart Andrew Sutton represented a professional in a collections trial in District Court.  The client was awarded about $8,000 in damages and almost $1,000 in attorney’s fees.   Practice pointer: Professionals and contractors should included a paragraph in their contract stating that the client or customer is responsible for the reasonable attorney’s fees and costs incurred in enforcing the contract.  The agreement should further state that the contract will not be merged into the judgment, but will survive it.  This will allow the court to award additional attorney’s fees and costs incurred in enforcing the ensuing judgment.
